Attorney Fitzsimmons also assists buyers with addressing zoning, land use, and financing concerns, and represents buyers of both bank-owned real estate and property subject to a short sale. Attorney Fitzsimmons also helps homeowners avoid foreclosure through loan modification.
Trusts, Estates, and Guardianships
Attorney Fitzsimmons’ estate and probate practice centers on trust and estate planning and administration, and guardianship and conservatorship law. Bridging with his litigation experience, Attorney Fitzsimmons concentrates on representing nursing home residents in appeals of denials of MassHealth benefits, and in defending estates from claims made by MassHealth for benefits paid.

In addition to representing clients in Medicaid appeals and defending estates from claims made by MassHealth, Attorney Fitzsimmons handles personal injury cases, construction-related claims, automobile-related consumer protection actions under c. 93A, and corporate litigation matters. In addition to his representation of clients before the District Court, Superior Court, and Massachusetts Court of Appeals, Attorney Fitzsimmons is also admitted to practice before the Federal Court for the District of Massachusetts.
