The Law Office of Matthew P. Fitzsimmons, P.C. provides legal advice and counseling in all areas of real estate, trust and estate planning and administration, business planning, and litigation.

Whether counseling business owners through litigation, advising a fiduciary on trust and estate administration, or representing a buyer or seller of real estate, Attorney Fitzsimmons aims to assist clients to understand the applicable law and to provide clients with counseling on the practical aspects of the legal process involved.

Real Estate

Attorney Fitzsimmons works with buyers and sellers of real estate throughout the purchase and sale process, from the time of exchanging offers and signing a purchase and sale agreement all the way through title examination and closing. Attorney Fitzsimmons reviews and resolves title issues, and regularly works with executors, trustees, and conservators preparing for the sale of real estate. Attorney Fitzsimmons also assists buyers with addressing zoning, land use, and financing concerns, and represents buyers of both bank-owned real estate and property subject to a short sale. Attorney Fitzsimmons also helps homeowners avoid foreclosure through loan modification.

Trusts, Estates, and Guardianships

Attorney Fitzsimmons’ estate and probate practice centers on trust and estate planning and administration, and guardianship and conservatorship law. Bridging with his litigation experience, Attorney Fitzsimmons concentrates on representing nursing home residents in appeals of denials of MassHealth benefits, and in defending estates from claims made by MassHealth for benefits paid.

Business Planning

Attorney Fitzsimmons assists each business client with the selection of a legal business entity to fit identifiable ownership and operation goals. A small business owner himself, Attorney Fitzsimmons counsels clients on the legal and practical aspects of starting, running, and growing a business, including drafting a business plan, incorporating, securing financing, hiring staff, negotiating commercial real estate and equipment leases, and developing a successful approach to management.

In addition to representing clients in Medicaid appeals and defending estates from claims made by MassHealth, Attorney Fitzsimmons handles personal injury cases, construction-related claims, automobile-related consumer protection actions under c. 93A, and corporate litigation matters. In addition to his representation of clients before the District Court, Superior Court, and Massachusetts Court of Appeals, Attorney Fitzsimmons is also admitted to practice before the Federal Court for the District of Massachusetts.
